Alright, the inside of your car lights up like a 70s disco club. You check your rear view mirror and yup you’re been pulled over by an officer of the law. Any idea what your rights are in this situation even if you did do something wrong? I’m Stefanie Schaeffer and this is Know Your Rights T.V. It’s important to be respectful to the officer making the traffic stop. Be compliant about providing the necessary documentation. These include license, registration, and proof of insurance. Also, you’re protected by the Fourth Amendment Right against some reasonable searches and seizures. Law enforcement officers use a set of rules known as Plain View Doctrine which means you really need to keep your personal or private effects out of the way of prying eyes. An officer may only initiate a searching seizure if in illegal item is in plain view. That gives them a reasonable cause. Now, plain view means in an open space. It doesn’t mean in a compartment and doesn’t mean under a seat. Just because an officer stops you and asked if he can search your vehicle, it doesn’t mean you have to say yes. If stopped, you can say no to warrantless searches. You’re covered by the Fifth and Sixth Amendments. If an officer asks questions, you are not obligated to answer any of them. If the officer continues to ask questions, simply say, that you refuse answer them without the advice of your lawyer. Better to air on the side of caution. Overall, use common sense. Be polite.
